These Terms and conditions govern the sale of the products offered on the website brunopremi.com by AWARDS SHOES S.R.L. Please read them before placing an order: by submitting your order you declare that you have read and accepted them.
1. SELLER
AWARDS SHOES S.R.L., registered office at Via dell'Industria 14, 35020 Brugine (PD), Italy, tax code and VAT number 05539300284, registered with the Companies Register of Padua under REA no. 474561, certified email awardsshoes@lamiapec.it, email support@brunopremi.com.
2. SCOPE
These Terms apply to all orders placed on the website. The Shipping policy and the Returns and refunds policy form an integral part of these Terms. The processing of personal data is described in the Privacy policy.
The website is intended exclusively for consumers, that is natural persons acting for purposes outside any business, commercial, craft or professional activity they may carry on.
To make a purchase you must have legal capacity and be at least eighteen years old.
3. PRODUCTS AND AVAILABILITY
The main characteristics of the products are described on their respective product pages. Images are for illustrative purposes: colours and details may differ depending on the settings of the device used.
Availability shown on the website is not a binding commitment. If a product turns out to be unavailable after your order has been submitted, we inform you without delay and refund in full any amount already charged, within fourteen days.
4. PRICES
Prices are expressed in euro and include VAT. Shipping costs, where due, are shown separately before the order is completed and summarised in the shopping cart.
We reserve the right to change prices at any time. The applicable price is the one shown on the website at the time the order is submitted.
In the event of an obvious material error in the price shown, we reserve the right to cancel the order, giving notice and refunding in full.
5. FORMATION OF THE CONTRACT
Submitting an order constitutes a contractual offer. The contract is concluded when we send the order confirmation email.
After submitting your order you receive a summary email containing the order details and a reference to these terms. Please check its content and report any errors to support@brunopremi.com.
We reserve the right not to process orders that show irregularities, that are incomplete or contain untrue details, or that come from parties with whom disputes or unpaid balances exist.
6. PAYMENTS
The following payment methods are accepted: credit and debit cards through Shopify Payments, PayPal and Klarna.
Payments are handled directly by the payment service providers, which act as independent controllers of the related data. We have no access to the full details of the payment instruments used and we do not store them.
If you choose a deferred or instalment payment method, the arrangement relating to the deferral is directly between you and the service provider, which may make acceptance subject to an automated assessment of your creditworthiness and may refuse the payment method requested. That provider's contractual terms and privacy policy apply.
The goods remain our property until the price has been paid in full.
7. TAX DOCUMENT
Sales made on the website are aimed at consumers and do not involve the issue of an invoice: the amounts received are recorded in accordance with the applicable tax rules. If you need an invoice, you must request it at the same time as placing your order, providing the details required for it to be issued.
The request for an invoice must be made at the time of the order. An invoice cannot be issued afterwards.
8. DELIVERY
Delivery times, costs, areas served and delivery arrangements are set out in the Shipping policy, which forms an integral part of these terms.
The risk of loss or damage to the products remains with us until the consumer takes physical possession of the goods.
9. RIGHT OF WITHDRAWAL
If you buy as a consumer you have the right to withdraw within 14 days, on the terms and in the manner described in the Returns and refunds policy, which also contains the model withdrawal form.
Pursuant to article 54-bis of the Italian Consumer Code, an online withdrawal function is available on the website, allowing you to exercise the right directly through the interface without sending separate communications. The function is located in the footer of the website, under the section dedicated to withdrawal, and is accessible throughout the withdrawal period. How it works is described in the Returns and refunds policy.
10. LEGAL GUARANTEE OF CONFORMITY
The products are covered by the two year legal guarantee of conformity from delivery provided for by the Italian Consumer Code in favour of consumers, with the right of action time barred after twenty six months. The procedure and the remedies are described in the Returns and refunds policy.
11. LIABILITY
We are liable as provided by law. Nothing in these terms limits or excludes liability for wilful misconduct or gross negligence, for personal injury, or any liability that the law does not allow to be limited towards consumers.
We are not liable for delays or failures to perform caused by force majeure or by events beyond our reasonable control, including strikes, natural disasters, measures taken by public authorities, interruptions of communication networks or of carrier services.
12. COMPLAINTS AND DISPUTE RESOLUTION
You may submit complaints to support@brunopremi.com or to awardsshoes@lamiapec.it. We reply within 2 working days.
If the complaint is not resolved, the consumer may turn to the alternative dispute resolution bodies listed in the registers kept by the competent authorities, pursuant to articles 141 and following of the Italian Consumer Code. Recourse to such bodies is optional and does not affect the possibility of bringing proceedings before the courts.
13. APPLICABLE LAW AND JURISDICTION
These terms are governed by Italian law. Any more favourable mandatory provisions of the law of the consumer's country of habitual residence continue to apply.
For disputes with consumers, the court of the consumer's place of residence or elected domicile has exclusive jurisdiction. For disputes with parties who do not qualify as consumers, the court of Padua has exclusive jurisdiction.
14. CHANGES
We may change these terms at any time. The terms applicable to each order are those published at the time the order is submitted.
15. FINAL PROVISIONS
If any individual clause is invalid or ineffective, this does not affect the validity of the remaining ones. Tolerating any breach does not constitute a waiver of the rights arising from these terms.
This document is drawn up in Italian. In the event of any discrepancy between the Italian version and versions in other languages, the Italian version prevails.
